Membership and Direct Debit Waiver
General conditions
All participants must abide by general terms and conditions of Vovinam. Management reserves the right to refuse entry, suspend or cancel a membership without refund, or request any person to leave the premises if that person does not behave in a responsible manner, uses abusive language, is under the influence of drugs and/or alcohol or does not adhere to the general conditions of entry. Every effort will be made to adhere to the timetable but Vovinam reserves the right to change and alter classes as necessary.
Privacy disclaimer
As a member of Vovinam, the centre may send out communications with you via email, phone or text. We sometimes film or photograph the facilities so it is possible you will appear in the images. By signing your agreement, you allow us to use your image in promotional and other business-related material.
Signing your agreement
You have an agreement with us when you have signed it and we have accepted it. If these terms and conditions or your agreement differ from anything you are told at the club or over the phone, these terms and your agreement will apply, unless written confirmation is received from Vovinam management.
Paying a start up fee
You do not need to pay a start up fee. Fees charged by us will include your class/training fees only.
Paying for ongoing memberships
You pay fees for ongoing memberships in advance each fortnight (unless specified otherwise in your agreement), by direct debit from a bank account or credit card. All direct debit memberships are on an ongoing basis, and will continue to be charged from your account, even after your minimum contract period of 12 WEEKS has finished, unless 14 days notice is provided from you in writing to Bluelegacy.inc@gmail.com.
Paying upfront
You can pay upfront for some memberships. For a Pre Paid membership, you will pay on the day you buy it. Pre-paid memberships are non-refundable.
Renewing your upfront membership
When your membership is due to end, you can choose to renew it before that date at your existing rate, otherwise your membership fee will be set at the current rate. By renewing your membership, you agree to the membership terms that apply at that time.
Paying your direct debit
We will debit your fees fortnightly (unless otherwise specified in your contract) from your nominated account, from your nominated start date, as set out in your membership agreement.
Please note that:
• debit fees apply to all bank account transactions at a rate set by the billing company, Vovinam.com.au. These will appear in your transaction history.
• additional fees apply to credit card transactions at a rate set by the billing company, Vovinam.com.au. These will appear in your transaction history.
• debits might take up to 5 days to come out of your account.
Meeting your responsibilities
Your responsibilities, including payment of membership fees, do not depend on how often you use the facilities.
You must make sure:
• your account can accept direct debits (your financial institution can confirm this)
• there is enough money in your account on the payment day and the next 5 days
• you tell us if you are transferring or closing your account, at least 48 hours before your next direct debit
• you tell us about any changes to your credit card, such as its expiry date or number, at least 48 hours before your next direct debit.
• you notify us in writing if you wish to make any changes to your account (Bluelegacy.inc@gmail.com)
Querying a payment
If you query a payment, we will do our best to respond within 7 days. If you are not happy with our response, you may contact your financial institution. It will handle your query in line with its own policy.
Failed payments
If you do not fully pay your fees, and your account remains overdue for an unreasonable time (as determined by Vovinam we may suspend your club access until your payments are up to date and you have given us your account details.
Our billing company, Vovinam.com.au, will also charge you a late payment fee of $5.99 for a failed payment. This will be debited from your account after a failed payment.
Cancellations
14 days notice is required in writing for all membership cancellations. All cancellation requests must be made in writing to Bluelegacy.inc@gmail.com. No refund will be given for any monies paid in advance. If notification is not received up to 14 days prior, the account will continue to be charged as agreed.
Transfer or refund of membership
Memberships are not transferable or refundable
Suspensions
Minimum of 14 days notice for the suspension of all memberships is required. Suspension requests must be made in writing to Bluelegacy.inc@gmail.com. No suspension request will be backdated under any circumstances. All suspensions are for a minimum of 2 weeks and a maximum of 8 weeks.
Additional fees for special services
Some services are not included in your membership and require an additional fee. These services include, but are not limited to:
- Personal training / private lessons
- Kids school holiday programs
- Seminars and courses
Paying additional service fees, including personal trainers
Contractors and tenants provide some services in our clubs, such as personal training.
You will need to pay service fees directly to them and we are not responsible for those fees or for any associated costs or refunds.
Your personal property
Please do not leave your gear at the gym. Vovinam takes no responsibility for your personal property, whether lost, misplaced or discarded.
Wearing suitable clothes
All members and guests must wear suitable clothes whilst training. We do not allow clothes with offensive images or inappropriate advertising.
All members MUST wear footwear in the toilet and bathroom areas.
We recommend that children have their names written inside their uniforms to avoid loss.
Damage to the facility
Any member who wilfully or through negligence damages the facility or its property will be asked to pay for the damage. Members are responsible for damages caused by their guests and children.
Respecting our equipment
You are responsible for using our facilities and equipment correctly, including adjusting levels or settings. If you are not sure how to operate any equipment, please ask our staff before you use it. Note that you will be responsible for any damage that you or your guests cause through a wilful act or negligence.
As a courtesy to other members, please:
• use a clean towel when you use equipment
• Put equipment away after use.
Safety, maintenance and service demand
Vovinam reserves the right to, from time to time and as reasonably necessary:
- Close off any part of the premises or equipment for safety or maintenance purposes.
- Change the hours of opening and closing, or alter class timetables in accordance with demand
- Update the gym rules. In this case, we will provide access to the new rules, which will also be made visible in the facility.
Promising you are in good health
On the day you sign your agreement and each time you use our clubs, you promise us that:
• you are in good physical condition
• you know of no medical or other reason why you cannot or should not do active or passive exercise.
Seeking expert advice
Our staff and contractors are not medically trained. They are not qualified to assess if you are in good physical condition and can exercise without risking your health, safety or comfort. If you have any doubts, we strongly urge you to seek expert advice before starting an exercise program.
Telling us about your health risks
If you believe any club activities might risk your health, you must tell us this in writing with full details. You must also tell us if your medical condition changes after you join.
We may choose to refuse your membership agreement until:
• your doctor agrees in writing that you are fit to exercise
• you show us proof that you have received medical advice on an appropriate exercise program.
Sickness and skin infections
If we believe you are at risk of infection to those around you with an illness (covid, the flu, a cold etc) or a sick infection (staph, ringworm etc) we have the right to suspend your membership until further notice/ you have recovered and you are no longer contagious. This is to protect the well-being of our members and staff.
Managing infections and illnesses
You must not use club facilities if:
• you have an infection, contagious illness or physical ailment, such as an open cut or sore
• there is any other risk, however small, to other members and guests
Respecting others
Be respectful and do not behave inappropriately towards other members, guests, our staff and outside providers. Examples of inappropriate behaviour include:
• verbal or physical intimidation;
• harassment;
• discrimination on the basis of race, sex, age or any disability another person may have
Breach of terms and conditions
Any breach of these terms and conditions may result in immediate termination of the membership at the discretion of Vovinam.
By submitting this waiver, I declare that I have read and fully understood every provision of this release; and that I am legally competent to and freely enter into this waiver, release and assumption of risk agreement. I acknowledge that the conditions set out in this document are contractual in nature, are intended to have legal effect and are not merely a warning or recital. I have signed this document on my own free will and without any representation or inducement by Vovinam and/or its employees. I further declare that I have no injuries, physical restrictions, disabilities or any predispositions to sickness or injury that may be aggravated or adversely affected as a result of my participation.
To ensure that every participant receives the maximum benefit from the programs and services at Vovinam, please take the time to read through the Terms & Conditions carefully.
Vovinam Viet Vo Dao Waiver & Release
By signing this form, the participant and/or the parent/guardian understands that there is a risk of personal injury in the course of instruction and, with this knowledge, agrees to assume the risk of any injury and damages to the participant during participation.
Specifically, the participant agrees to hold harmless Vovinam and all other individuals, organisations, sponsors, promoters, operators, hosts, instructors, associations, schools, owners, officials, directors, employees and other participants connected with the business from all losses, damages, injuries, causes of actions, claims, or complaints in the event that the participant is damaged or injured in any way during the participation, instruction and/or performance of any exercise or during any activity associated with the the business location or during transit to or from the business.
The participant further agrees to strictly obey instructors and observe safety rules.
Because of the physical demands of martial arts and/or personal defence instruction, the participant understands that he/she must be in good physical condition to participate in the event. Participants understand that in case of injury, the only medical treatment Vovinam will provide is first aid.
In the event of an emergency, the participant hereby authorises any licensed medical personnel to perform any accepted medical procedures deemed necessary and agree to bear the expenses of any such treatment.
The participant agrees that any pictures, audio, or visual recordings taken of him/her in connection with the seminar or class can be used for publication, promotion, articles, shows and advertisement without additional consent and without compensation at this time or any other time.
I, the undersigned participant, understand the risk of studying Martial Arts and on behalf of myself, my heirs, executors and administrators I hereby release Vovinam and all instructors and all other students of Vovinam from any and all liabilities of any nature (including any costs, whether or not the subject of a court order,) for any type of injuries or loss sustained while training, studying, practising or in the application of Martial Arts.
I, the undersigned, also state that I am in good physical condition and know of no reason why I cannot study and participate in Martial Arts or any activities held by Vovinam .
By signing this form, I, the undersigned, accept and understand the practice of Martial Arts Involves the risk of serious injury.
The participant agrees that Vovinam may take photographs and may make video and audio material of members classes and events, and that these materials may be used for display, promotion and/or advertising, or sold for profit, and the participant hereby waives any compensation to which they may otherwise be entitled for appearing in such materials.
I have read and understand this release and agreement and agree to its provisions. I am not under their influence of any drugs, alcohol, or other intoxicants. I am not suffering from any illness or incapacity. I am over 18 years of age. (If not over 18 years of age, parents or guardians must sign.)
